H.P. High Court provides relief to Kinnaur occupants

  • High Court Order of 9th July provides relief to occupants by quashing DFO orders;
  • High Court Bench puts ball in DFO Kinnaur’s court to hear matter;
  • High court mentions FRA and gives liberty to make submissions under FRA to State government.

The orders of the Hon’ble High Court, dated 6th April 2015, followed by subsequent orders for strict implementation, regarding removal of encroachments on Forest land (CWPIL 17/2014) and the response of the State Government to the issue have become a major cause of concern for occupants of forest land in Himachal. The Forest Department, following these orders started conducting a blanket eviction drive using ‘Public Premises and Land (Eviction and Rent) Recovery Act (HPP&L (E&RR)).

In Kinnaur the Divisional Forest Officer, had last year issued show-cause notices, to more than 90 occupants under the HPP&L (E&RR) Act 1971. The occupants filed their objections on the grounds of being right-holders under the Forest Rights Act 2006. But the DFO did not hear the matter, nor passed any order in it. On 27.3.2018 the office of the DFO issued summon orders for the occupants. Some of the occupants approached the High Court demanding quashing of the DFO orders. The prayer also sought directions for authorities to process the claim of the petitioners as filed under the Scheduled Tribes and other traditional Forest Dwellers (Recognition of Forest  Right) Act, 2006 and Rules.

The High Court in this CWP No. 766 of 2018 issued the orders with following decisions on 9.7.2018.

  1. The DFO Kinnaur order dated 3.2018 be quashed on the basis of violation fundamental rights of Scheduled tribes. Therefore, the applicability of the order in non-tribal belts where hearing on encroachment cases is on-going in the court of the Divisional Forest Officers as well as in Revenue courts, is not clear
  2. The original proceeding initiated by the DFO, Kinnaur has been restored. This means that the petitioner(s) will have to file a fresh reply in the DFO court to counter the proceedings initiated by the DFO court under the provisions of Himachal Pradesh Public Premises and Land (Eviction and Rent Recovery) Act, 1971. In this regard petitioners have to be appear on 20th July 2018 in the DFO court. Petitioner can place additional information in front of DFO court.

It is important for the petitioners to move their plea in front of DFO court based on Section 4(1) of the FRA which overrides all other legislations, to recognise and vest forest rights to Scheduled Tribes and Other Forest Dwelling Communities. The use of the HP Public Premises and Land (Eviction and Rent) Recovery Act for eviction thus be termed illegal because the Forest Rights Act has already vested the rights to the occupants on forest lands.

  1. The DFO is directed by High Court to pass order with reason within a 3-month period.
  2. Petitioner can approach authorities of the State government regarding applicability of the provisions of FRA, 2006.

किन्नौर के ‘कब्जाधारियों’ को हिमाचल प्रदेश उच्च न्यायालय ने दी राहत

  • 9 जुलाई को पास हुए हाईकोर्ट आर्डर ने DFO के आर्डर को खारिज करते हुए लोगो को राहत प्रदान की|
  • हाईकोर्ट बेंच ने कोई ठोस निर्णय ना लेते हुए मामले की बागडोर को DFO किन्नौर के हाथो में सोंप दिया|
  • वन अधिकार क़ानून का ज़िक्र मात्र करते हुए हाईकोर्ट आर्डर लोगो को वन अधिकार कानून के अंतर्गत फाइल प्रस्तुत करने की स्वंतंत्रता प्रदान करता है|

माननीय हाईकोर्ट द्वारा 6 अप्रैल 2015 को पास किये गए आर्डर व उसके उपरांत जंगलात जमीन से अतिक्रमण व अधिभोगियों को हटाने हेतु (CWPIL 17/2014) सख्त रूप से क़ानून का लागू करना एवं प्रदेश सरकार व प्रशासन का रवैय्या, हिमाचल में मोजूदा अधिभोगियों के लिए एक अत्यंत चिंताजनक विषय बन चुका है| इन आदेशों का पालन करते हुए वन विभाग ने ‘पब्लिक प्रिमासिस एंड लैंड (एविक्टिअन एंड रेंट)रिकवरी एक्ट’ (HPP&L (E&RR)) (‘सार्वजनिक परिसर और भूमि (बेदखली और किराया) वसूली अधिनियम’ (HPP&L (E&RR))) के तहत हिमाचल में बेदखली की प्रक्रिया को संपूर्ण रूप से शुरू कर दिया |

गत वर्ष किन्नौर जिले में DFO ने लगभग 90 से भी ज्यादा अधिभोगियों को अधिनियम HPP&L (E&RR) 1971 के तहत कारण बताओ नोटिस जारी किया| अधिभोगियों ने जबकि वन अधिकार क़ानून 2006 के तहत खुद को अधिकार धारक बताते हुए आपति याचिका भी दायर की लेकिन DFO ने ना तो इस पर किसी प्रकार कि कोई सुनवाई की ना ही कोई आदेश जारी किया | 27 मार्च 2018 को DFO दफ्तर ने जब इन अभिभोगियों के खिलाफ समन आदेश जारी किया तब कुछ अधिभोगियों ने हाईकोर्ट में DFO आदेश को खारिज करने हेतु याचिका दायक की व साथ ही अधिकारियों को वन अधिकार क़ानून के अंतर्गत भरे गए दावों की प्रक्रिया को पूरा करने हेतु दिशानिर्देश की भी माँग की |

2018 की याचिका संख्या 766 (CWP no. 766) के सन्दर्भ में हाईकोर्ट ने 9.7.2018 को निम्न फैसलों के साथ आदेश जारी किये :

  1. दिनाक 3.2018 को दिए गए DFO आदेश को अनूसूचित जनजाति के मौलिक अधिकारो के उल्लंघन में खारिज किया जाता है | इसलिए गैर जनजातिय इलाको में इस अद्देश की मान्यता व DFO और राजस्व न्यायलयों में जहाँ इसकी सुनवाई की प्रक्रिया जारी है वो  स्पष्ट नहीं है |
  2. DFO द्वारा हुई मूल कार्यवाही को किन्नौर में बहाल किया जाता है अर्थात याचिकाकर्ताओं को DFO न्यायालय में DFO द्वारा ‘सार्वजनिक परिसर और भूमि (बेदखली और किराया) वसूली अधिनियम’ (HPP&L (E&RR)) के अंतर्गत हुई कार्यवाही के सन्दर्भ में वापस से जवाब एव सुनवाई का अवसर प्रदान किया जाता है | इस सुनवाई के लिए याचिकाकर्ताओं को दिनाक 20 जुलाई 2018 को DFO दफ्तर में हाज़िर होना होगा जिसमे उन्हें नयी जानकारी देने की स्वतंत्रता है |
    इसलिए यह अत्यन्तं महत्वपूर्ण है की याचिकर्ता DFO दफ्तर में अपनी याचिका वन अधिकार क़ानून के धारा 4(1) के अनतर्गत करे क्योकि धारा4(1) अनूसूचित जनजाति व अन्य परम्परागत वन निवासियों को धारा 3 में उल्लेखित वन अधिकारो की मायता प्रदान करती है व उनमे निहित करती है एव धारा4(5) के तहत जबतक वनाधिकारो की मान्यत की प्रक्रिया पूरी नहीं हो जाति किसी भी अधिभोगी को बेदखल नहीं किया जा सकता|
  3. हाईकोर्ट DFO को आदेश देता है की वो इस कार्यवाही को 3 मॉस के समय में पूरा करे कारण देते हुए आदेश जारी करे|
  4. याचिकर्ताओं को स्वतंत्रता है की वो वन अधिकार क़ानून 2006 के प्रावधानों व प्रक्रिया को पूरा करने के सन्दर्भ में प्रदेश सरकार एव प्रशासन को पहुँच सकते हैं|
