प्रेस विज्ञप्ति: 3 अप्रैल 2019: वन अधिकार के लिए ‘चलो मंडी’ का नारा दिया 11 अप्रैल को देंगे जिला कार्यालय के सामने धरना

आज 3 अप्रैल को हिमाचल वन अधिकार मंच ने मंडी में एक प्रेस वार्ता में बताया के 11 अप्रैल को वन अधिकार कानून को प्रभावी और न्यायपूर्ण तरीके से लागू करने की मांग को ले कर मंडी में सेरी मंच पर होगा एक दिवसीय धरना. मंच के सदस्यों ने बताया कि यह कानून हिमाचल राज्य की खेती बाड़ी और पशुपालन पर टिकी आम जनता के लिए अत्यंत महत्वपूर्ण हैं परन्तु प्रदेश की सरकारें तथा प्रशासन दोनों ही इस कानून को लागू करने में विफल रहें हैं.

2006 में भारत के संसद ने वन भूमि पर निर्भर सभी समुदायों के हितों की रक्षा और उनके अधिकारों को कानूनी मान्यता देने के लिए वन अधिकार कानून 2006 (Forest Rights Act,2006) पारित किया. यह कानून किसी भी प्रकार की वन भूमि में लागु होता है. इस कानून को लाने की आवश्यकता ही देश में इसलिए पड़ी क्यों की देश भर में वन भूमि पर अपनी आजीविका के लिए निर्भर समुदायों को कानूनी अधिकार नहीं मिल पाए क्यों की देश के वन कानून बहुत कड़े थे. देश भर में इस कानून के तहत पिछले 10 वर्षों में लाखों लोगों को फायदा मिला है परन्तु हिमाचल में केवल 129 दावे मंज़ूर हुए हैं.

ऐसा इसलिए हुआ की प्रशासन और जिम्मेदार अधिकारियों की इस कानून को ले कर कई गलत फेह्मियां रही हैं और पूरी जानकारी व ज़रूरी प्रशिक्षण के अभाव में कई गलत प्रक्रियाएं भी हुयी. वर्ष 2014 से पूरे मंडी ज़िले में पंचायत सचिवों के माध्यम से विकास परियोजनाओं को वन भूमि प्रदान करने के नाम पर गैर कानूनी फ़ार्म पर वन अधिकार समितियों एवं ग्राम सभाओं से यह लिखवा लिया गया की लोगों के जंगलों और वन भूमि पर कोई वन अधिकार नहीं हैं और ‘शुन्य/निल’ दावों के सर्टिफिकेट ले लिए गए. इसी तर्ज़ पर चम्बा में भी प्रशासन ने काम किया और अब कांगड़ा ज़िले में प्रशासन ने 90 दिन की समय सीमा लगा कर सभी समितियों से ये शून्य दावे के सर्तिफिकेट ले रही है.

जबकि केवल मंडी ही नहीं बल्कि पूरे राज्य में देखें तो लाखों परिवार खेती और रिहाइश के लिए कई सालों से वन भूमि पर बिना पट्टे के काबिज हैं. ऐसे परिवारों पर बेदखली का खतरा मंडराता रहता है. ऐसे परिवार इस कानून के तहत हकदार हो सकते हैं और व्यक्तिगत दावे पेश कर सकते हैं. साथ ही अपने गुजर बसर के लिए वन भूमि पर लकड़ी, पत्ती, घास, जड़ी बूटी, खड्ड, नाले, रेत बजरी आदि के लिए निर्भर समुदाय सामूहिक अधिकारों के लिए हकदार हैं.

परन्तु ‘शून्य दावों’ की गलत प्रक्रिया की वजह से व्यक्तिगत और सामूहिक पट्टों के लिए दावे करने की प्रक्रिया ही रुक गयी है.

हिमाचल वन अधिकार मंच की सबसे प्रमुख मांग यह है की चंबा और मंडी में हुए इन गलत प्रस्तावों और शुन्य दावों की गैरकानूनी ‘निल सर्टिफिकेट’ को प्रशासन द्वारा तुरन्त खारिज किया जाय. साथ ही ऐसी प्रक्रिया कहीं और चलाई न जाये. जो कांगड़ा और कुल्लू में 90 दिन की समय सीमा दे कर पंचायत सचिवों के माध्यम से इस कानून को लागू करवाया जा रहा है यह गलत है और इस पर तुरंत रोक लगनी चाहिए. तीसरी मांग यह है की सभी वन अधिकार समितियों, राजस्व, फारेस्ट, पंचायती राज विभाग के अधिकारियों को इस कानून की पूरी जानकारी और सही प्रशिक्षण देने का काम सरकार द्वारा जल्द से जल्द किया जाये. तथा लंबित दावों की जो फाईलें उप जिला स्तर और ज़िला स्तर पहुंची हैं उनपर समयबद्ध तरीके से निर्णय लिया जाये.

दिसंबर 2018 के धरमशाला विधान सभा सत्र में किये गए वादे के मुताबिक़ सरकार को वन अधिकार कानून लागू करने के लिए कई प्रभावी कदम उठाने होंगे. जनवरी 2019 में हुई राज्य स्तरीय निगरानी कमिटी में मंच के सदस्यों ने यह सारे मुद्दे उठाये थे और इस पर कई सकारात्मक निर्णय लिए गए थे – इनको भी सरकार ने अब तक लागू नहीं किया है – इन पर तुरंत कार्यवाही होनी चाहिए

हिमाचल वन अधिकार मंच हिमाचल प्रदेश के अलग अलग क्षेत्र के संगठन और सामुदायिक संस्थाओं का मंच है जो वन अधिकार कानून 2006 को हिमाचल में प्रभावी तौर से लागू करवाने के लिए कार्यरत है|

Press Note: 3 April 2019: Call for protest on non implementation of Forest Rights Act; Mass demonstration at Mandi on 11th April 2019

Himachal Van Adhikar Manch in a press conference held at Mandi today on 3rd April announced that a one day protest demonstration would be held on 11 April 2019 at Seri Manch, Mandi for the speedy and just implementation of the Forest Rights Act, 2006. Members of the Manch reinforced that despite the significance of this Act for the communities in Himachal Pradesh whose livelihoods are dependent upon agricultural and livestock rearing, the State government and bureaucracy have both failed to implement this Act efficiently on the ground.

The Forest Rights Act was passed by the Parliament of India in 2006, with the aim of protecting the interests as well as providing legal recognition and recording the rights of the communities dependent on forest land for their bonafide livelihood needs. The law extends to forest land of any description without any exclusion. The need to bring this law emerges to undo the historical injustice that has long been perpetuated on the forest dependent communities that have been traditionally been dependent upon  these forest lands but have not been able received any legal rights on the same owing to the stringent forest laws of the country. Lakhs of people all across the country have benefited during past 10 years under this act but in the state of Himachal Pradesh merely 129 claims have been recorded till now. Such indolence in the implementation of this act has continued because of misunderstandings and doubts about the act amongst the concerned authorities and bureaucracy as well as due to lack of any technical training on the act for the line officials.In 2014, in order to ease out forest land diversion for development activities, all Forest Rights Committees and Gram sabhas in the entire Mandi district have been made to pass blanket resolutions as ‘nil certificates’ through the Panchayat secretaries declaring that the people in the area do not have any forest rights or claims under the mentioned act. Thus based on this Zero/Nil Claim certificates have been issued from the entire district. (PFA copy of such certificates)

A similar approach has been carried out in the District of Chamba whereas in Kangra district, the bureaucracy is on the drive of collecting similar Nil cerrtificates by putting a timeline of 90 days for FRA claim collection. This is impossible to achieve when people have no idea about the provisions of the Act itself.

Not just in the district of Mandi but in the entire state more than lakhs of families have held the forest land under occupation since much before the cut off date of 13th December 2005 prescribed under the Act, for the purpose of agriculture and day to day living. These families have been facing the threat of eviction and living in insecurity and it is only under the FRA 2006 that they can claim individual rights for the occupied land and ensure their livelihoods. These lakhs of forest dependent households that rely on forest land for fuel wood, timber,  fodder, streams, herbal medicines, stone and sand etc., are also eligible to claim for community rights over the same under this act.

But due to the wrong and illegal process of issuing Nil certificates, the process of claiming individual and community forest rights claims has also halted and demotivated the people.

Himachal Van Adhikaar Manch very strongly and critically demands that these illegal and unjust Zero Forest Rights Claims and subsequent Nil certificates be declared null and void with utmost urgency as well as this illegal  process should not be undertaken in any other district in Himachal Pradesh.

Secondly, the un-provisional process of settling Forest rights through Panchayat Secretaries by putting a time limit of 90 days in the district of Kangra and Kullu be immediately put to halt.Thirdly , members of Himachal Van Adhikaar Manch affirms and demands that the governments must provide proper information and organize trainings for all the members of Forest rights Committees, and concerned line departments (Revenue, Forest and Panchayati Raj),  so that  a time bound and in informed decision can be taken on the files lying delayed in SDLC and DLC .

While many were promises made by the state government during the Winter session of Vidhaan Sabha in December 2018 for implementation of the act in ‘mission mode’, no effective steps have been taken for effective and expeditious implementation of the Forest Right Act.

The Manch had raised amongst other issues the issue of the NIL certificates with the State Level Monitoring Committee looking into the act, and the same was discussed in its meeting held in January 2019 (PFA Proceedings). The Committee called for a withdrawal of these certificates apart from taking other affirmative decisions for FRA implementation but none of them have been executed so far.

The State government must promptly look into the matter and take immediate actions on the same.
