Himachal finally moving on Forest Rights Act implementation
Chamba-Lahaul lead, titles awaited in Kangra District
After many years of delay, the last few months have seen some progress with regard to the implementation of the Forest Rights Act 2006 in the State of Himachal Pradesh. Two of the districts that have taken the lead in issuing titles under the act, which gives legal recognition to the individual and community user rights over land under the jurisdiction of the Forest Department, are Chamba and Lahaul-Spiti. Last month, on the 70th Independence Day the Health & Family Welfare Minister Shri Kaul Singh Thakur distributed 16 individual land titles under the Forest Right Act, 2006 in Lahaul and Spiti district. After Chamba, where 7 community titles over 1890 hectare and 53 individual titles have been recognized and vested, Lahaul and Spiti has become the second district where people have got titles under FRA 2006.
Meanwhile, Kangra which has the highest number of filed claims under individual and community rights, 81 and 43 respectively, from Baijnath, Palampur and Dharamshala tehsils, is yet to recognise any. Despite the fact that some of these claims were filed as long back as 2014, no decision has been taken on these by the administration.
The 8 titles in Lahaul were given in Stingri village, 7 in Shooling village and 1 in Gondhala village, last month. These titles were given to the families who had their houses constructed on forest land before 13th December 2005. However, earlier in the year the administration cut the electricity connections here on the basis of the Shimla High court order on illegal encroachments on the forest land.
According to Rigzin Hyreppa from “Save Lahaul and Spiti” who is coordinating the process of implementation of FRA 2006 in the district, “This was possible with the combined effort of district administration, Himachal Van Adhikar Manch a state level alliance of organizations working on implementation of FRA 2006 in Himachal and with active support from Shri Ravi Thakur, MLA from Lahaul and Spiti district.”
Shri Prakash Bhandari from HVAM stated, “This is an encouraging step and it will help in furthering the spread of FRA 2006 not only in Lahaul and Spiti but in other parts of Himachal. We look forward to recognition of claims in Kangra District now where we have put in a great deal of work in facilitating the process of claim filing”
The convenor of HVAM Akshay Jasrotia, stated that “the decision taken by the State level Monitoring Committee held on 25th July 2017 gives lot of hope which clearly instructs all the DCs to make all the efforts to finalize community rights, as the rights of communities are well recorded so it will not be difficult for them to be recognized under FRA 2006″. To achieve the recognition of rights, the SLMC has made provisions of training programmes for the staff of line departments involved in the implementation of FRA 2006.”

वन अधिकार कानून २००६ पर हिमाचल के प्रशासन ने बढाए कदम
लाहौल- चम्बा में अधिआकर दिए, कांगड़ा में बात आगे बढ़ने का इंतज़ार
कई वर्षों के डामाडोल और विलम्ब के बाद आखिर हिमाचल में वन अधिकार कानून २००६ के पूरी तरह लागू होने के आसार नज़र आ रहे हैं. वन अधिकार अधिनियम २००६ एक केंद्रीय कानून है, जिस के अंतर्गत वनाश्रित समुदायों को वन विभाग के नियंत्रण में ज़मीन पर अपने व्यक्तिगत एवं सामूहिक उपयोग के लिए दावे पेश करने का और अधिकार लेने का प्रावधान हैं. हिमाचल में यह कानून 2012 में पूरे राज्य में लागू था परन्तु इसी वर्ष चम्बा और लाहौल ज़िलों में लोगों द्वारा पेश किये गए दावों पर कार्यवाही की प्रक्रिया शुरू कर पट्टे जारी किये गए हैं.
पिछले महीने देश के ७०वे आज़ादी दिवस पर राज्य के परिवार एवं बाल कल्याण मंत्री श्री कॉल सिंह ठाकुर ने इस कानून के तहत 16 व्यक्तिगत दावों पर लाहौल में पट्टे जारी किये. इससे पहले चम्बा ज़िले में 1890 हेक्टेयर पर ७ सामूहिक और ५३ व्यक्तिगत दावे स्वीकार कर पट्टे जारी किये गए. हालांकि कांगड़ा ज़िले में सबसे अधिक दावे भरे गए हैं, बैजनाथ, पालमपुर व धरमसाला से 43 सामूहिक और 81 व्यक्तिगत, परन्तु प्रशासन द्वारा अभी इन पर निर्णय नहीं लिया गया है. जबकि यह दावे पेश करने की प्रक्रिया ३ वर्ष पहले से चल रही है.
लाहौल में हाल में दिए गए पट्टों में स्टिंगरी गाँव में 8 , शूलिंग में 7 और गोंधला में 1 शामिल है. सेव लाहौल स्पीति के रिग्जिन हायरप्पा के अनुसार “वन अधिकार कानून की प्रक्रिया लाहौल में आगे बढ़ाने के लिए जन संगठनों – जैसे हिमाचल वन अधिकार मंच , जिल्ला प्रशासन और यहां के जन प्रतिनिधि श्री रवि ठाकुर का सहयोग रहा है”. हिमाचल वन अधिकार मंच के कार्यकर्ता श्री प्रकाश भंडारी का कहना है कि, ” यह एक छोटा परन्तु महत्त्वपूर्ण कदम है जिससे लोगों को दावे पेश करने में प्रोत्साहन मिलेगा और हमें आशा है कि कांगड़ा ज़िले में भी पट्टे जल्द ही जारी किये जाएंगे”.
मंच के संयोजक श्री अक्षय जसरोटिया के अनुसार, ” वन अधिकार अधियम 2006 के अंतर्गत बनी राज्य स्तरीय मॉनिटरिंग कमेटी के 25 जुलाई 2017 को लिए गए निर्णय के अनुसार सभी जिला उपायुक्तों को निर्देश दिया गया है की सामूहिक अधिकार देने की प्रक्रिया को तेज़ किया जाए क्यों की यह अधिकार पहले से बंदोबस्ती में दर्ज हैं तो इन को कानूनी मान्यता देने का कार्य इतना मुश्किल नहीं होगा। इस के लिए कमिटी ने सभी प्रशासनिक अधिकारीयों हेतु प्रशिक्षण के लिए भी प्रावधान किया है, जिससे यह प्रक्रिया कारगर हो सके”.
